【摘要】高空抛物侵权案件在我国呈频发态势，特别是重庆“烟灰缸”案件引起社会广泛关注，在法学界对其也展开了激烈的争论，然学者众说纷坛，莫衷一是。笔者怀着关切的心情一直关注这一类型侵权案件，对各位学者争论也产生了好奇，认真梳理他们的观点，发现他们的观点虽具有一定合理性，但还存在着某些瑕疵，值得商榷。
本文主要阐述了严格责任与高空抛物侵权行为。介绍了新《侵权责任法》视角下的高空抛物侵权行为与建筑物责任关系。阐述了我国侵权法中严格责任现实地位。解析了高空抛物损害与严格责任的适用。最后对高空抛物损害责任案件的严格责任解析。
