摘 要:在经济和技术全球化的趋势下，知识产权保护已经成为国际和国内的热点问题，尤其是发展中国家的知识产权政策，已成为本国能否克服短期技术困境、促进经济长期增长的关键因素。改革开放以来，特别是 90 年代以后，外商在中国的直接投资有了巨大的增长，中国在 1979 年以前几乎没有外商直接投资，而到 2013年，仅1~3月一个季度中国利用外商直接投资金额达299.05亿美元，同比增长1.44%。对外商投资的充分利用极大地推动了我国的技术进步、经济增长和对外贸易发展。知识产权保护国际化对发展中国家就意味着需要提高本国的知识产权的保护水平，使其逐渐达到和发达国家的相同的保护水平。相对于发达国家来说，发展中国家的技术创新能力非常不足，在这种情况下，提高发展中国家的知识产权水平势必会对发展中国家吸引国际直接投资产生重大的影响。
本文试图在前人研究基础上，借鉴现有研究成果，.通过建立计量模型分析在知识产权保护下，我国的FDI技术溢出效应及知识产权保护程度对其影响。针对我国目前知识产权保护程度对FDI技术溢出的影响效果，建议我国政府应结合我国当前发展水平，顾及我国财政，贸易，金融政策以及产业政策和企业的发展需求，制定我国自己知识产权战略，对于转变我国经济增长模式也有借鉴作用，因此研究本课题有重要实际意义。

ABSTRACT:Ever since the social and economic openness of China in 1990, the inflow of foreign capital has been increasing significantly. Date back to 1979, there are barely foreign direct investment projects to be found in China. Since 2013’s first season, within a few decades, the amount of FDI is 29.9 billion USD. The average growth rate of FDI was up to 13%. Such a rapid influx of FDI provides necessary financial resource for China as a powerhouse of international trading. The nation also enjoyed the spillover of such money inflow, which lightened the hope for technology advancement as well as innovation.
The essay will discuss issues rose from IP protectionism, approaching by analyzing the different investment strategies and studying on the dynamics between the FDI and social well-beings. A comparable model of an enterprise in development country verusacounter part in developing country is employed. It is assumed under the condition of IP protectionism exists, how the technology spillover derived by FDI influences the social well-beings.
Consequently, the data generated from China was explored to justify the influence of the intellectual protection technology, which confined to the overflow of China FDI technology and social welfare.
