摘要:权利质权，因其并不妨碍出质人对出质权利的使用、收益，在现代市场经济社会中具有很大的发展前景。在我国，权利质权制度立法还比较简单，立法体系存在缺陷，不能真正发挥融资担保的作用。有鉴于此，本文通过分析权利质权的制度价值，立足我国立法现状，指出我国权利质权制度的不足之处，通过借鉴国外权利质权成功的立法经验，就完善我国权利质权制度提出若干意见。

Abstract:The pledge of rights, the quality of its pledgor does not preclude the usufruct, economy and society in the modern market has great prospects for development. In China, pledge to right the system is relatively simple legislation, legislative system is flawed, can not really play a role in financing secured. This paper analyzes the value system of pledge of rights, according to our legislative situation, pointed out that China's pledge to right the deficiencies, by borrowing the pledge of rights of legislative experience, to improve the quality of China's pledge to right to put forward views.
