摘要：商品房预售方式是当前商品房买卖当中的重要方式，其对房地产开发商筹集资金，促进房地产行业的发展有着重要的作用。虽然发展中存在着种种弊端，但是其实施的过程当中牵扯到了各个方面的利益关系，因此对其存废应当站在一个整体的利益角度去考虑，而不应当贸然废除，而应当加以完善以更好地发挥其作用。本文从房地产市场的准入和退出的立法规制、预售信息披露法律制度、信息披露监管机制、预售款的监管制度和商品房预告登记制度等方面来加以完善，从而完善我国的商品房预售法律制度。

Abstract:The way of purchasing for commodity houses is the current of commodity house business of important. It is important for real estate developers to raise funds and promoting the development of the real estate industry. Although various defects existing in the development，but its implementation process involved all aspects of the interest relations .So about its existing or abolishing，we should look it in an overall benefit to consider，and should not be rushed abolished，and should be improved to better play its role. This article from the real estate market access and withdrawal legislation regulation，open to booking information disclosure law system，disclosure supervision mechanism，open to booking a paragraph of regulatory system and commodity house advance notice registration system to be perfect，in order to perfecting our commodity house opens to booking a legal system.
