试论家事案件执行的困境与对策.doc

摘要:家事案件执行具有不同于一般民商事案件执行的显著特点，这类案件的执行，并不仅仅是简单地强制实现判决书上确定的权利，还需要顾及相关当事人的情感和将来良好关系的维持。解决这类案件执行难得问题，必须首先完善我国的现行立法，对家事案件执行设专章加以规定，以便执行人员树立新的执行理念，制定家事案件执行多样话执行措施和规范它的执行调解的制度。促进社会和谐，真正实现家事案件的执行目的。

Abstract:The enforcement of family case are more different from that of civil case and they have their own specialties which not only need force the party to party to perform their duty, but also need to remain the good relationship  between parties in the future .In order to resolve the problem of performance of adjudication  of family case .we should modify the civil procedure law ,and ordain special regulation on the enforcement of family case ,in the meantime ,let the executor set new idea in the course of enforcement ,and really realize the aim of performance of domestic cases.

　　　家事案件，是指与婚姻家庭有关的案件。我国民事执行中涉及家事纠纷的案件主要包括遗产继承，离婚财产分割、赡养费、抚养费、探视权、交出子女、离婚财产分割等几类情形、这类案件的执行特点跟一般民事案件执行有所不同，在执行当事人、执行标的、执行理念、执行终结乃至执行所涉及的利益等方面均有自己的独特之处。因此，有必要对我国家事案件执行中存在的问题进行探讨，并提出有效的完善措施。
