论土地承包经营权股权化制度的完善.doc

摘要:在我国，农民是最大的社会群体，土地在他们的心目中具有不可替代的特殊地位。法学界历来对土地制度和农村土地承包经营权制度存在着不同的看法。笔者认为完善我国土地承包经营权股权化制度是非常有必要，现行土地承包经营权股权化制度存在着诸多弊端，因此应该建立更加适合我国国情的土地承包经营权制度，引导社会资本投入农村，促进农村土地资本化，实现撂荒地的使用价值，实现农业产业化、规模化经营，促进农业增产、农民增收，保护农民的利益。

关键词：土地承包经营权；股权化制度完善

Abstract:In China, farmers are the largest social groups, and an irreplaceable special status of land in their minds. Jurisprudence has always been the land system and rural land contract management right system there are different views. I believe that to improve our land contract and management rights demutualization regime is necessary, the existing land contract and management rights equity of the system there are many shortcomings, and should therefore be more suitable for China land contract and management rights system, to guide the social capital investment in rural areas, promote capital of rural land, abandoned land use value, to achieve the industrialization of agriculture, large-scale operation, promote agricultural production and farmers' income and protect the interests of farmers.

　　　农村土地承包经营权是农民安身立命的根本，它是以家庭联产承包制为基础的农村土地承包经营权制度。家庭联产承包责任制是政府尊重农民的创造精神，尊重农户的市场主体地位而产生的。家庭联产承包责任制是农民创造的，虽具有显明的时代特征却已不能适应时代的需求。随着我国经济改革的进一步深入，随着我国城市化建设的发展，当前的农村土地承包经营权股权化是解决农村土地产权移转的一种新模式，但是由于其本身存在的不足，使得其辐射的区域范围和推进速度非常有限。在这里，我拟从土地承包经营权股权化的法律基础、法律关系及参股农民的股权保护方面进行一些探讨。
