摘要:不动产预告登记制度源于普鲁士法,后为德国、瑞士、日本和我国台湾地区民法所继受。《中华人民共和国物权法》第20条明确规定了不动产的预告登记制度。该制度弥补了我国不动产登记制度体系的空白,为我国不动产登记制度的一大进步。然而,简单一条法律条文还不足以完善不动产预告登记制度。因此,本文拟就此问题进行探讨,以为完善该制度尽绵薄之力。本文首先阐述不动产预告登记制度的价值;其次,分析我国不动产预告登记制度的不足;再次,通过比较法研究德国、瑞士、日本和我国台湾地区不动产预告登记制度;最后,提出完善我国不动产预告登记制度的设想。

Abstract:The system of advance notice registration of real property derived  from the law of Prussia, and adopted by Germany, Switzerland, Japan and Taiwan. The system of advance notice registration of real property  was established by The Real Rights Law of the People’s  Republic of China which is ruled in the twentieth article. The establishment of it make up real property registration system of our country, marking a big step in the system of advance notice registration of real property. Nevertheless, such one simple article can not perfect the system of advance notice registration of real property. Consequently, the article discusses the problem and makes an effort to improve the system. First, the article introduces the value of the advance notice registration of real property. Further, the article discusses the shortage of the advance notice registration of real property of our country. Next, the article researches the system of advance notice registration in Germany, Switzerland, Japan and Taiwan by comparative law. Finally, the article puts forward the improvement of the system of advance notice registration of our country.

   在商品房预售中,不动产物权人滥用权利,利用强势地位和占有优势追求利润最大化,违反合同之约,违背诚实信用,一房数卖,导致不动产买受人的期待利益不能实现。由于预告登记制度的存在,不动产买受人只需基于登记机关的公示而信赖交易,防止了一物数卖的交易风险和免受不动产物权人欺骗。简言之,不动产预告登记制度保护了交易安全,促进了交易效率,符合最广大人民的根本利益。
